ORDER:-

This writ petition is filed for a writ of mandamus to declarethe action of the respondent in not considering and disposing ofthe application of the petitioner dated 14.12.2007 registered asR.No.833/B1/07 said to have been filed by him for grant of renewalof permits bearing Nos.28/64 and 27/64 valid up to 31.12.2007, asillegal and arbitrary.

Heard the learned counsel for the petitioner and the learnedAssistant Government Pleader for Transport.

At the hearing, Sri E. Maruthi Raja, learned counsel for thepetitioner submitted that though the petitioner submittedapplication dated 14.12.2007, which was registered by therespondent as R.No.833/B1/07, the same is not disposed of. Hesubmitted that the permits held by him are expiring on 31.12.2007and unless their renewal is made, he will be forced to stop plyingof the vehicles.

Learned Assistant Government Pleader for Transportpointed out that the petitioner has not filed a copy of theapplication said to have been filed before the respondent forrenewal.

Ordinarily, this writ petition would not have been entertainedas the petitioner failed to file the copy of the application said tohave been filed before the respondent for renewal, but in view ofthe fact that he gave the registration number evincing receipt and registration of his application, I do not want to non-suit him only onthe ground of non-filing of the application.

Since the relief sought for by the petitioner is veryinnocuous, the writ petition is disposed of with the direction thatthe respondent shall forthwith dispose of the application of thepetitioner, if it was already filed by him and registered as claimedby him in this writ petition.

As a sequel to disposal of the writ petition,WPMP.No.37115 of 2007 filed by the petitioner for interim relief isdisposed of as infructuous.
