Petition under Article 226 of the constitution of India praying that in thecircumstances stated in the Affidavit filed herein the High Court may be pleased toIssue a writ, order or direction more particularly one in the nature of writ ofmandamus declaring the action of the respondents 1 to 4 in not taking any action onthe representations submitted on 1.4.2004 & 5.5.2004 and further action of the 4threspondent in issuing Proc. dated. 22.11.2003 as highly illegal arbitrary andconsequently direct the respondents to take action as per law on the representations dated. 1.4.2004 & 5.5.2004.

The Court at the admission stage made the following :ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleaderfor Revenue and with their consent the writ petition itself is disposed of at the stageof admission.

The grievance of the petitioners is that though the villagers of AmaramKandriga and Marati Gate villages of Nandimangalam Gram Panchayat, PutturMandal, Chittoor District submitted representations, dated 01-04-2004 and 05-05-2004 to the first respondent for construction of irrigation tank in Survey Nos.222 and225 and for removal of stone crusher therein being run by one M. ChandrasekharNaidu, which is causing sound and air pollution in the area and the animals grazingthere died due to the hit of stones released from the crusher, no action has beentaken so far. Hence, the writ petition.

Having regard to the facts and circumstances of the case, the first respondentis directed to consider the representations, dated 01-04-2004 and 05-05-2004 saidto have been submitted by the villagers of Amaram Kandriga and Marati Gatevillages of Nandimangalam Gram Panchayat, Puttur Mandal, Chittoor District, andpass appropriate orders thereon in accordance with law, expeditiously.

With the above direction, the writ petition is disposed of at the stage ofadmission. No costs.
