ORDER:
This writ petition is filed for a writ of mandamus to set asidenotification, dated 15.11.2006 issued under Section 4(1) of the LandAcquisition Act, 1894 (for short ‘the Act’) and all other consequentialproceedings taken thereto in respect of lands admeasuring Ac.2.36cents and Ac.1.20 cents belonging to petitioner Nos.1 and 2respectively, comprised in Survey No.180 of Bhadravaram Village ofYeleswaram Mandal, East Godavari District.
At the hearing, learned counsel for the petitioners submitted thatthe only ground, on which, the petitioners filed this writ petition is thatthe proposed acquisition is in violation of the provisions of AndhraPradesh Agricultural Land (Conversion for Non-Agricultural Purposes)Act, 2006 (for short ‘the 2006 Act’).
Today, in a batch of writ petitions, namely, W.P.No.18881 of2006 and batch, this Court after detailed consideration of the saidissue, negatived the said contention and held that acquisition ofagricultural land without conversion under the provisions of the Actcannot be invalidated on the ground of violation of the provisions of the2006 Act.
In view of the above and following the said judgment, this writpetition is dismissed with the direction that the detailed reasonscontained therein shall be read as part of this order.
