ORDER:
This petition is filed seeking withdrawal ofH.M.O.P.No.34 of 2011 (HMOP) pending on the file of theCourt of Senior Civil Judge, Tenali, and transfer the sameto the Family Court, Visakhapatnam, for trial and disposalaccording to law.
The petitioner herein is the respondent and therespondent herein is the petitioner in the HMOP.
The marriage between the petitioner and respondenttook place on 3.9.1993 and they were blessed with twochildren. The plea of the respondent herein is that thepetitioner herein subjected her to harassment and unableto bear the cruel attitude of the petitioner he left hercompany and has been living separately and thereafter,he filed the HMOP for the dissolution of their marriage.
The petitioner’s plea is that she has to look after theirchildren and has got life threat in the hands of therespondent and it is difficult for her to cover long distanceto attend the Court, and hence the H.M.O.P. is to betransferred to the file of the Judge, Family Court, Visakhapatnam, which would not cause anyinconvenience or hardship to the respondent, fordisposal.
There is no good basis about the threats. But thepetitioner who is a lady will have a difficulty to attend theCourt which is at long distance from the place of herresidence. Further, it appears that she has to take care oftheir children.
Having regard to the facts and circumstances of thecase, the petition is allowed. H.M.O.P.No.34 of 2011pending on the file of the Court of the Senior Civil Judge,Tenali, is transferred to the Court of the Judge, FamilyCourt, Visakhapatnam, for disposal in accordance withlaw. The transferee Court is directed to dispose of thematter within a period of six months from the date ofreceipt of a copy of this order in view of the circumstancesof the case.
