ORDER:

Tl-ris ',r,rit petition is being disposed of [at ][the ][admission]stage ',r,ith the consent of learned [counsel ][lor ][the ][respective]parties.

This writ petition is [filed ][seeking ][the ][follou'ing relief:]

".... to issue an appropriate [Writ ][Order ][or ][direction]more particularly one in the [nature ][of ][Writ ][of]Mandamus declaring the action [of ][the ][respondents ][in]not considering the claim of the [petitioners ][for]appointment to the [post of ][Junior ][Assistant ][or ][any]suitable post agarnst [the vacancy ][position ][available ][as]on 30.06.2020 issued by the [Public ][Information]Officer vide Letter [No.Dir(HR)/DS(Estt,) ][&]PIO/DM/HR(RTI & PR)/Po.N/753 l2020-6' [dated]30.09.2020 under displaced [persons/Lztncl ][Looscrs]qr,r()ta in tcrms of G.O.Ms.No.9il, [clu ][tted ][15.04.19fi(r]ancl G.O.Ms.No.68. d:rted [17 ][05.2014, ][as ][illegal,]arbitrary aI-rd r,iolative of [Articles ][14, ][l6 ][and ][2l ][ol ][the]Constitlltion of India, and [consequently, ][direct ][the]responclents to consider [the ][claim ][ol ][the ][petitioners]and issue appointment [order ][for the ][post ][of ][Junior]Assistant or any suitable [post ][against ][the ][vacancy]position available as on 30.06 [2O2O ][in ][terms ][of]G.O.Ms.No.98, dated [15.04. ][1986 ][ar-rd ][G.O.Ms.No.68']dated 17.05.2014 and to [pass ][such other order ][or]orders......"

Heard Ms. Nagavani [Prasoona, ][learned ][counsel]for the [petitioners, learned Government ][Pleader ][for]appearing Enerry and Ms. A. [Deepthi, ][learned ][Standing ][Counsel]appearing for respondent [Nos.3, ][4 ][and ][6.]

It has been contended by petitioners [that ][they' ][are ][all]displaced persons as the respondents [have ][acquired their]lands during 1975'77 for the construction [of ][Srisailam ][Hydro]Power Project and the State Government [has ][come ][up ][with ][a]Power Policy vide G.O.Ms.No.98, dated [15'04.1986 ][for]providing empioyment to such of those displaced [persons,]whose lands were acquired for the Power [Projects, ][Power]House, Canal Distributory Systems etc. The [petitioners ][are]eligible for employment in terms of the [said ][Power Policy vide]G.O.Ms.No.98, dated 15.04.1986. [However, ][the ][respondents]are not considering their cases [for ][employment ][in ][terms ][of ][the]said Power Policy. Though the [petitioners made ][repeated]representations dated [17 ].O8.2O2O and [08.10.2020, ][the]respondents are not passing any orders [on ][the ][said]representations.

Learned counsel for the petitioners, [therefore,]contended that the writ petition be [disposed ][of ][directing ][the]respondents to consider the representations [dated]17.O8.2O20 and 08.10.2020 submitted by [the ][petitioners ][and]pass appropriate orders in accordance with law.

Learned Standing Counsel appearing [for ][the]respondents - Corporation had contended that [since ][there ][are]certain vacancies, the cases of the petitioners would [be]considered as and when the respondents undertake [the]recruitment process. Learned Standing Counsel had further contended that since representations dated 17.O8.2O2O and08.10.2020 of the petitioners are pending with the08.10.2020 of the petitioners are pending with therespondents, the respondents would consider the same andpass appropriate orders in accordance u.ith lau,.pass appropriate orders in accordance u.ith lau,.

This Court, having considered the rival submissionsmade by learned counsel for the respective parties, is of theconsidered view that this rvrit petition can be disposed ofdirecting the respondents to consider the representationsdated 17.OB.2O2O and 08. 10.2020 submitted theby petitioners and pass appropriate orders in accordance withlaw within a reasonable period, preferably within a period offour months from the date of receipt of a copy of this order.

With the above observations, this writ petition1Sdisposed of. No order as to copts.
