THE HON’BLE SRI JUSTICE C.V.RAMULU W.P.No.6429 of 1999

ORDER:

The issue that arises for consideration inthis writ petition is squarely covered by aJudgment of this Court reported in Tyre[[1]]Retreading Shop Committee v., APSRTCwhereunder it was held that imposition ofpenal wage cut for the days for which theworkmen of Road Transport Corporation haveabsented themselves in concert withoutapplying for leave; the provisions of Paymentof Wages Act, 1936 have no application.

Under those circumstances, the writ

petition is allowed and the impugned order isset aside. However, this will not preclude the respondents from taking appropriate action as per law. No costs.
