DT.31.12.2010

Between:

Venkatram

And

… Petitioner

The District Collector, Nalgonda District Counsel for the Petitioner:Sri M.V.Hanumantha RaoCounsel for respondents: AGP for Panchayat Raj … Respondent The Court made the following ORDER:

ORDER:

This writ petition is filed for a mandamus to declare the inaction ofthe respondent in disposing of the petitioner’s representation, dated25.11.2010, as illegal and arbitrary.

I have heard the learned counsel for the petitioner and the learnedAssistant Government Pleader for Panchayat Raj.

The petitioner is a ward member of Huzurnagar Gram Panchayat. He alleged that the Sarpanch of the Gram Panchayat was placed undersuspension by the respondent and that on the Sarpanch approaching theGovernment, the order of suspension was set aside, subject to hisremitting back the amount, which was allegedly misappropriated by him, within a prescribed time. The petitioner averred that as the said amount was not remitted back as directed by the Government, he has maderepresentation, dated 25.11.2010, to the respondent to take actionagainst the Sarpanch for non-compliance of the order of the Government. Feeling aggrieved by the inaction of the respondent in disposing of therepresentation, the present writ petition is filed.

After hearing the arguments of the learned counsel for thepetitioner and the learned Assistant Government Pleader for PanchayatRaj, I am of the opinion that interests of justice would be met if therespondent is directed to dispose of the petitioner’s representation andtake appropriate action according to law against the Sarpanch, aftergiving notice to him, within a period of four weeks from the date of receiptof a copy of this order. Ordered accordingly.

Subject to the above direction, the writ petition is disposed of.

As a sequel to disposal of the writ petition, W.P.M.P.No.42592 of2010 filed by the petitioner for interim relief is disposed of as infructuous.(C.V.NAGARJUNA REDDY, J)
