By filing this petition [under ][Anicle ][226 ][of ][the ][Constitution ][of]India, petitioner has [challenged ][the ][legality ][and validity ][of ][the ][notice]dated 01.12.2021 [issued ][to ][him ][by ][respondent whereby, ][petitioner ][has]been informed thar [the ][secured ][asset ][would ][be ][sold ][byauction or ][even ][by]private sale byfixing [the ][reserve ][price ][at ][Rs.58'60,000.00']

l. \7e find from the documents [on ][record ][that ][as ][per ][the ][respondent,]the outstanding liabilities of [the ]Petitioner [as ][on ][05'10'2019 ][is]Rs.48,91,142.00.

4. Leamed counsel for [the petitioner ][submits ][that ][even after ][this ][date,]substantial payments [have been made ][bythe ]Petltloner'

From the above, [whar ][is ][evident ][is ][that ][respondent ][has ][taken action]against the petitioner [under ][the ][provisions ][of ][the ][Securitisation ][and]Reconstruction of [Financial ][fusets ][and ][Enforcement ][of ][SecuriryInterest]Act,2Oa2 [(for ]shon the [SARFAESI ][Act) ][read ][with ][the provisions ][of ][the]Interest [(E ][nforcement) ][Rules, 2002.]Security

6. Under Section [17 ][of ][the ][SARFAESI ][Act, ]Petidoner [has ][got ][an]adequate and efficacious [remedy. ][ve ][are, ][therefore, ][of ][the view ][that]petitioner should be [relegated ][to ][the ][forum of ][altemative remedy']
