THE HONOURABLE SRI JUSTICE P. SWAROOP REDDYCRIMINAL PETITION No.11164 OF 2009ORDER:

This Criminal petition under Section 482 Cr.P.C. is filed by thepetitioners – accused Nos.1 to 5 seeking to quash the proceedings inCrime No.61 of 2009 of Inavolu Police Station, Guntur District,registered for the offence punishable under Section 304 (B) read with34 IPC.

2. Heard.

3. The offence alleged is serious being one under Section304(B) IPC, but the 164 Cr.P.C. statements of the parents of thedeceased, of whom, mother the first witness, who is the complainant isthat the deceased committed suicide obviously on account of stomachache and as she was not taken for treatment by them (Parents). Considering these circumstances, it is directed that the petitioner shallnot be arrested till filing of charge sheet, if any. The investigation andconsequential steps on the basis of result of investigation shall go on.

4. The Criminal Petition is accordingly disposed of at the stageof admission.
