ORDER:Heard leamed counsel [for ][the ][petitioner ][and ][leamed]Assistant Govemment [Pleader ][for ][Revenue.]

2. In view of the nature of [relief ][sought ][by ][the ][petitioner,]this Writ Petition is [disposed ][of, ][at ][the ][admission ][stage ][dispensing]with notice to respondent [No.4. ][Petitioner herein ][is ][claiming ][that ][he is]absolute owner and [possessor ][of ][land ][admeasuring ][Ac.2-26 ][gts in]Sy.No.l5l/Al, situated [at ][Channupalli ][Village, ][Ananthagiri ][Mandal,]Suryapet District, [on ][the ][strength ][of ][an unregistered sale deed ][dated]15.06.2002 executed by respondent [No.4 ][and ][his ][father. ][Referring ][to]memo dated 17.04.2019 [issued ][by ][respondent ][No'3/Tahsildar,]Ananthagiri Mandal and [report ][dated ][08.02.2019 ][of ][Mandal ][Revenue]Inspector, leamed counsel for [the ][petitioner ][would ][submit ][that]petitioner is in possession of the aforesaid [property and there ][is]now. [The ][suit ][vide ][O.P.No.306 ][of ][2003 ][filed ][by ][family]standing crop members of respondent No.4 [seeking ][partition ][and ][the ][same ][was]decreed. Respondent No.4 filed [suit vide ][O.S.No.l68 ][of ][2009 ][to]declare that the said decree and Judgment [in ][O.P.No.306 ][of ][2003 ][is]null and void and it is not binding on him. [During ][the pendency ][of ][the]

aforesaid [proceedings, respondent ][No.4 ][had ][approached ][the]respondent No.3 with a [request ][to ][mutate ][his ][name ][and ][issue]E-Pattadar passbook [in ][his ][favour in ][respect ][ofaforesaid ][property, ][but]the said application [was ]not [considered. ][Therefore, he has filed]W.P.No.2247 of [2019 seeking ][direction ][to ][respondent ][Nos.2 ][and 3 ][to]consider the representation [submitted ][by ][him ][seeking ][mutation ][and]for issuance of E-Pattadar [passbook ][and ][the ][said ][Writ ][Petition ][was]of vide [order dated ][11.02.2019 ][directing ][the ][respondent]disposed Nos.2 and 3 to consider the [said ][representation. ][Contempt ][Case]No.766 of 2019 [was ][filed ][for ][alleging ][willful ][violation of ][the ][aforesaid]order. Vide impugned [endorsement ][No.B/73l2016 ][dated ][03'01'2022,]respondent No.3 informed [the ][petitioner ][that ][he ][is ][not ][competent]authority to issue [E-Pattadar ][passbook ][and ][title ][deed and ][his ][request]was forwarded to [respondent ][No.2. ][Therefore, according ][to ][the]petitioner, respondent No.2 is [going ][to ][consider ][the ][same ][and]therefore he has [submitted objections dated ][05.12.2022 ][to ][the]respondent No.2 with [a ][request ][not ][to ][entertain ][the ][application]submitted by respondent [No.4 ][seeking ][mutation ][and ][issuance ][of]E-Pattadar [passbook. ][But, ][copy ][of ][the ][said ][objections ][would ][reveal]that petitioner herein [had ][submitted ][said ][objections ][to respondent ][No.3]but not to the respondent [No.2. ][Copy ][of ][the ][same ][filed ][by ][the]

petitioner said to have been submitted to respondent No.2 does notbear acknowledgement, in proof of service of the same on respondentNo.2.

In view of the aforesaid discussion, this Writ Petition isdisposed of granting liberfy to the petitioner to submit objections torespondent No.2 along with copies of aforesaid memo dated17.04.2019 of respondent No.3 report of Mandal Revenue Inspecror,other documents and on receipt of the said objections, respondentNo.2 shall consider the same while conducting enquiry in compliancewith the order dated 11.02.2019 in W.P.No.2247 of 2019 pursuanr toendorsement No.Bl73l20l6 dated 03.01.2022 of respondent No.3, byputting the petitioner, respondent No.4 and all effected parties onnotice and affording them an opportunity of hearing. If, respondentNo.2 is not inclined to accept the request made by the petitioner, videthe aforesaid objections dared 05.12.2022, he shall assign specificreasons and pass a reasoned order, communicate copy of the saidorder to tlie petitioner as well as respondent No.4. He shall completethe aforesaid exercise as expeditiously as possible. There shall be noorder as to costs.

As a sequel, the [miscellaneous ][petitions, ][if ][any, pending]

in the Writ Petition shall stand [closed.]
