HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDYWRIT PETITION No.41088 of 2014Date:31.12.2014

Between:

Nannam Ashok Babu,S/o Late Ankalu

..... Petitioner

And:

The State of Telangana., reptd by its PrincipalSecretary, Civil Supplies Department,Hyderabad and three others.

.....Respondents

Counsel for the Petitioner: Sri K.Srinivas Counsel for the Respondents: AGP for Civil Supplies (AP)

The Court made the following:ORDER:

The grievance of the petitioner in this Writ Petitionis that though his temporary fair price shop authorization issubsisting, respondent No.4 has stopped allotting theessential commodities to him for distribution to the cardholders.

A perusal of proceeding in Rc.No.6833/2011-B,dated NIL.03.2012, issued by respondent No.3 shows thatthe petitioner was appointed as temporary fair price shopdealer in the vacancy caused on account of the death ofhis father. Indeed, the petitioner being the legal heir isentitled to be appointed as permanent fair price shopdealer as per G.O.Ms.No.4, Consumer Affairs, Food andCivil Supplies (C-I) Department, dated 28.02.2014.

Surprisingly, instead of appointing the petitioner as the fair price shop dealer on permanent basis, respondentNo.4 is stated to have stopped release of the essentialcommodities to the petitioner for no reason. Therefore, respondent No.4 is directed to forthwith release theessential commodities to the petitioner for distribution tothe card holders.

Subject to the above direction, the Writ Petition isallowed.

As a sequel to disposal of the Writ Petition,W.P.M.P.No.51462 of 2014 filed by the petitioner forinterim relief is disposed of as infructuous.
