Date: 31.12.2015
Between:Buradagunta Deva Deepthi
..
Petitioner
andBuradagunta Subhash Chandra Bose
.. Respondent
Counsel for the petitioner: Mr.K.Ramachandra The Court made the following:
O r d e r :
This Civil Revision Petition arises out ofOrder, dated 18-11-2015, in IA.No.1272 of 2015 inDOP No.1174 of 2011, on the file of the Court of thelearned I Additional District Judge, Guntur.
The respondent filed the above-mentioneddivorce OP against the petitioner. Pending the OP,he has filed IA.No.1272 of 2015 seekingappointment of an Advocate-Commissioner forrecording cross-examination of the petitioner asRW.1 and other witnesses on her behalf. Thisapplication was, accordingly, allowed by the lowerCourt.
At the hearing, Mr.K.Ramachandra, learnedCounsel for the petitioner, submitted that while hisclient has no objection for appointment of anAdvocate-Commissioner for recording her cross-examination, in the affidavit filed in support of theIA, the respondent has stated that he has filedseveral documents on his behalf; that thosedocuments have to be marked on his side and thatas the evidence on the respondent’s side wasalready closed, no further documents on his side could be marked.

A perusal of the order under revision showsthat the lower Court has not granted any permissionto the respondent to mark further documents on hisside. On the contrary, it has allowed IA.No.1272 of2015 and appointed an Advocate-Commissioner forrecording the cross-examination of RW.1 and otherwitnesses on her behalf. In the absence of anypermission granted by the lower Court for markingfurther documents on the respondent’s side, theapprehension of the petitioner, based on which thepresent Civil Revision Petition is filed viz., that therespondent may be permitted to mark furtherdocuments on his side, is without any basis.
Hence, the Civil Revision Petition isdismissed.
As a sequel to dismissal of the Civil RevisionPetition, CRPMP.No.7471 of 2015, filed by thepetitioner for interim relief, is disposed of asinfructuous.
