ORDER:-
This Criminal Petition, under Section 482 Cr.P.C., is filed by thepetitioner to recall the Non-bailable warrant issued against him on25.04.2012 in S.C.No.141 of 2011 on the file of the I Additional AssistantSessions Judge, Warangal.
2. The petitioner, who is sole accused, is facing trial for the allegedoffences under Sections 366, 342, 420, 496 and 506 IPC in S.C.No.141 of2011 on the file of the I Additional Assistant Sessions Judge, Warangal. Consequent on his failure to appear before the trial Court, NBW came to beissued on 25.04.2012. Aggrieved by the same, the present petition is filed.
3. It is contended by learned counsel for the petitioner that N.B.W came tobe issued against the petitioner consequent on his failure to appear on oneadjournment and therefore his absence on solitary occasion cannot beconstrued that he avoided trial of the case. He further contended that thepetitioner has been selected in DSC 2012 and has been preparing forinterview due to which he has not attended the Court and that if the petitioneris sent to judicial custody, he will loose his employment.
4. In view of the facts and circumstances, the petitioner is directed toappear before the trial Court and on such appearance, the trial Court shallrecall the NBW issued against the petitioner making it clear that he shall notabsent in future while the trial of the Sessions Case is in progress.
5. Accordingly, the Criminal Petition is disposed of.
