.....RESPONDENTS

Counsel for the Appellant:MR.S.RAVINDRANATH

Counsel for the Respondent No.1: GP FOR LABOUR.Counsel for the Respondent No.2: -- The Court at the admission stage made the following Order:(per TMK,J)

This writ appeal is filed against the order of a learned single Judge of this Courtin WPMP.No.33996 of 2003 in W.P.No.26846 of 2003, dated 26.12.2003.

The appellant filed the above WPMP to suspend the proceedings inI.D.No.39 of 2002, dated 07.08.2003 of the first respondent.

Learned counsel for the appellant contended that the order of the learnedSingle Judge amounts to implementation of the award.

We do not find any force in the argument advanced by the learnedcounsel for the appellant in view of the fact that the learned single Judge in theimpugned order observed that the promotion of the second respondent pursuantto the award passed by the Labour Court shall be subject to the result of thewrit petition.

The writ appeal is accordingly dismissed. No costs.

The Registry is directed to post the writ petition for final hearing in thesecond week of March, 2005.
