ORDER:

The Writ Petition is filed challenging the action of the respondents in not grantingrelaxation insofar as the petitioners are concerned on par with the similarly situatedpersons in various cadres including promotion to the category of personal officer, and not promoting them as personal officer, the present writ petition is filed.

The learned counsel for the petitioners contended that the persons similarly placedin the category of the petitioners have been given promotions as Personal Officers. Therefore, the present writ petitioners are illegally discriminated.

On the other hand the learned Standing Counsel for the respondents contended thatonly after considering the petitioners’ case in accordance with the rules andregulations of the Corporation, not granted any relaxation.

Therefore, without entering into the merits of the case, it would suffice in the interestof justice to direct the respondents to consider the petitioners’ case, if other personssimilarly situated in the category of the petitioners have been exempted in givingpromotions.

Accordingly, the Writ Petition is disposed of directing the respondents to considerthe case of the petitioners, in case any relaxation was given to the similarly situatedpersons, in accordance with rules and regulations of the Corporation within a period of two months from the date of receipt of a copy of this order. No costs.

Dated 31-12-2004.
