Petition under Article 226 of the Constitution of India prayingthat in the circumstances stated in the Affidavit filed herein the High Courtmay be pleased to issue any appropriate writ, order or direction more in thenature of a Writ of Mandamus declaring the action of the 2nd respondent inissuing the notice proceedings No. 1242/2008-A, dated 12-12-2008 in FormV based on the letter date 08-8-2008 given by the respondents 3 to 17 asarbitrary, illegal and contrary to the procedure prescribed under section 245(1) of A.P. Panchayat Raj Act and the Rules under GO Ms.No. 200, P.R. R.D.(Mandal-I) dated 28-4-1998 and consequentially set aside the notices dated08-12-2008 of the respondents 3 to 17 and notice proceedings No.1242/2008-A, dated 12-12-2008 issued by the 2nd respondent declaring theentire proceedings initiated by the respondents as illegal;

The petition coming on for hearing, upon perusing the petitionand the affidavit filed herein and upon hearing the arguments of M/s. M.BHASKARA LAKSHMI, Advocate for the Petitioner and of the Govt. Pleaderfor Panchayat Raj for the respondent No.1 and of the Govt. Pleader forRevenue for the respondent No.2, and of Sri K. Sitaram, Advocate for therespondent No.3, the Court made the following:

ORDER: Post on Tuesday “ for admission’ in the ‘ motion list’ by whichdate, the learned counsel for the third respondent undertakes to file thecounter.

In the meanwhile, the meeting proposed under the impugnednotice may go, but the out come shall not be given effect to.
