THE HONOURABLE SRI JUSTICE G. KRISHNA MOHANREDDY

C.R.P.No.3529 OF 2012

ORDER:

This Civil Revision Petition is directed against orderdated 26.06.2012 passed in I.A.No.1336 of 2012 inO.P.No.912 of 2011 (IA) by the Family Court, RangaReddy District at L.B.Nagar, Hyderabad.

The respondent herein is the wife of the petitioner. Their marriage took place in 2010. The OP was filed onthe following grounds by the petitioner. The marriage wasnot consummated. Since the marriage, there has been no cordial relationship between them. The respondent isnot interested in the family life. She used to quarrel withthe petitioner on one pretext or the other and harassedhim (the petitioner) due to her mental disorder. Thereafter, the respondent voluntarily left the company of thepetitioner. Therefore, unable to bear the mental agony, the petitioner filed OP.

The IA in question now was filed by the respondentseeking interim maintenance of Rs.30,000/- per monthagainst the petitioner. The Court below after analyzing thematerial on record and after hearing the learned counselon either side, granted interim maintenance @ Rs.8,000/- per month to the petitioner.

Learned counsel for the petitioner submits that thefather of the petitioner died and all the burdens fell uponhim by reason of which, he incurred huge debts and it isdifficult for him to pay the amount as claimed by therespondent. He further submits that necessarydocumentary evidence was placed before the Courtbelow, but without considering the same, the Court belowgranted the interim maintenance, which is exorbitant. Hefurther submits that the petitioner is ready and willing topay maintenance at Rs.4,000/- in view of his financialconstraints.

There is no material produced by the petitioner beforethe Court below to show that he incurred debts as claimedby him. Further, the petitioner has admitted that his salaryis Rs.78,000/- per month. So, granting of Rs.8,000/- permonth towards her interim maintenance is reasonable.Hence, there are no grounds to interfere with the orderpassed by the Court below.

Accordingly, the civil revision petition is dismissed.
