ORDER:
1 Brief facts are that petitioner was arrayed as accused inCr.Nos.127, 248 and 249 of 2000 of Crime Police Station Patamata,Vijayawada for the offences punishable under Sections 379 and 411 of IPCand in that connection the respondent herein opened a history sheet againsthim. After investigation in all the above crimes, the respondent filed chargesheet, which was numbered as C.C.No.188 of 2001 on the file of the Courtof I Additional Chief Metropolitan Magistrate, Vijayawada. After trial the saidCourt acquitted the petitioner from all the charges and at present there areno cases pending against him. The grievance of the petitioner is thatdespite the said acquittal by the competent criminal court in all the abovecrimes and though there are no cases pending against him, the respondentis still continuing the history sheet opened against him. Hence heapproached this court and filed the present Writ Petition assailing the actionof the respondent in continuing the said history sheet against him.
2 Heard both sides.
3 When once the petitioner was acquitted from all the casesregistered against him by a competent criminal court and no cases arepending against him as on the date, the respondent ought not to havecontinued the history sheet opened against the petitioner.
