THE HON’BLE SRI JUSTICE B.SESHASAYANA REDDYCriminal Petition No.9326 of 2012

ORDER:

The petitioners are A-1 and A-3 in Crime No.5 of 2012 of VatchavaiPolice Station, Krishna District, registered for the offences under sections307, 324, 149, 147 and 148 of I.P.C.

This is the second bail application. Earlier bail application inCrl.Petition No.1431 of 2012 filed by them came to be dismissed by order dt.10-2-2012.

Heard learned counsel appearing for the petitioners and learnedAdditional Public Prosecutor appearing for the respondent-State.

It is contended by learned counsel appearing for the petitioners thatpolice completed investigation and deleted some of the accused at the timeof filing charge sheet, that itself speaks faulcity of the accusations levelledagainst the petitioners by the complainant. Therefore, the petitionersdeserve for grant of anticipatory bail.

Earlier bail application came to be dismissed, taking intoconsideration the specific overtacts attributed to them. It is not the case ofthe petitioners that the witnesses have not stated their participation in thecommission of offence. Merely, because of some of the accused deletedfrom the array of the accused is not a ground to grant anticipatory bail to thepetitioners. I do not see any changed circumstances to ennure the benefitof the petitioners to renew his request for grant of anticipatory bail.

Accordingly, the Criminal Petition is dismissed.
