Learned [counsel ][for ][the ][petltioners ][would submit ][the]petitionershavepurchased200kgsofJaggeryandthesameWaSbeing [carried ][in ][the ][vehicle' ][ie'' ][Ashok Leyland ][LMV ][bearing]No.TS-23-T-5592, [belonging ][to ][the petitioner ][No ][l ][While ][carrying]thesaidstock,.respondentNo.4stoppedthesubjectVehicleandtook the [same ][into ][his ][custody' ][Without issuing ][any ][notice ][and]WithouttherebeinganyexpIanationfromthepetitionerS,therespondent [No.3 ][seems ][to ][have ][initiated ][confiscation ][proceedings]on [the ][report, ][dated ][03 02 ][2021' ][of the ][respondent No'4']basing which is arbitrary and iliegai. It is further contended that the orderdated 27.10.2021 confiscating the subject vehtcle Governrnenf, is iltegatt tnfavour ofarbitrary and without jurisdrction.

The allegation is that the subject vehicle was used in thecommissionof the offence in the subject crime.Ad m ittedly,against theimpugned order, dated 21.10.2021, thepetitionershave a remedy of appeal before the Commissioner ofProhibitionand Excise. It is pertinent to state that when an eFfective andefficacious remedy is available to the petitioners as indicatedabove, it is not appropriate to this Court to exercise the jurisdictionunder Article 226 of the Constitution of India.
6. With the above observations, this Writ petition is disposed ofgranting riberty to the petitioners to fire an appear before theCommissioner of [prohibition ]and Excise against the impugnedorder, dated 21.10.2021, seeking release of the subject vehicle, inaccordance with the procedure established under law. lt isneedless to mention that on filing of such an appeal by the iI
