HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDYWRIT PETITION No.40810 of 2014Date:31.12.2014

Between:

B.Obulappa,S/o B.G.Narasimhappa

..... Petitioner

And:

The State of A.P., reptd by its PrincipalSecretary, Civil Supplies Department,Hyderabad and three others.

.....Respondents

Counsel for the Petitioner: Sri P.Narahari Babu Counsel for the Respondents: AGP for Civil Supplies (AP)

The Court made the following:ORDER:

This Writ Petition is filed for a Mandamus to setaside proceedings in Rc.No.302/2008/C, dated09.04.2008, of respondent No.3.

The grievance of the petitioner is that in spite oforder, dated 01.08.2014, in Writ Petition No.16077 of2014, respondent No.4 has not resumed allotment ofstocks to him for distribution.

In my opinion, this Writ Petition is whollymisconceived for the reason that if respondent No.4 hasnot been complying with the above-mentioned orderpassed by this Court in Writ Petition No.16077 of 2014,the appropriate remedy for the petitioner is to institutecontempt proceedings against the said respondent.

In this view of the matter, the Writ Petition isdismissed with liberty to the petitioner to avail the remedyof contempt.

As a sequel to dismissal of the Writ Petition,W.P.M.P.No.51146 of 2014 filed by the petitioner forinterim relief is dismissed as infructuous.
