ORDER: (ORAL)

This writ petition is filed by the petitioners challenging theorder of the eviction dated 05.12.2023 vide proceedingstnRc.No.B/263l2023 by respondent No.4 - Tahsildar, DammapetaMandal, issued under Section 6 of the Tclangana LandEncroachment Act, I 905 [(for ]short 'the Act, I 905').

2- Learned Assistant Governmeut Pleader for Revenue hastaken prelirninary objection about maintainability of wlit petitionand submitted that the petitioners have an alternative remedy ofappeal under Section 10 the Act, 1905.

3. [,earned counsel for the petitioners has submitted thatexplanation submitted by the petitioners to the show-cause noticedated 04.09.2023 were not considered, hence, there is violation ofprinciples of natural [justice, ]thus, the petitioners are constrained toapproach this Cour1.

4. Learned Assistant Government Pleader has submitted thatsuch point can be raised before the appellate authority and thepetitioners are in illegal occupation of land in Survey No.8 ofVadlagudem Vil lage, Dammapeta Mandal, Badradri-KothagudemDistrict. The said land is Govemment land. As per the revenuerecords, it is recorded as Kharij Khata,/Sarkari, as evident from thePahani for the year 1958-59. Fufther, the subject land is inScheduled area and petitioners are non-tribals and they are notentitled for patta of the Scheduled land.

Having regard to the above facts and circumstances of thecase, this Court is not inclined to entertain this writ petition aspetitioners have an effective altemative remedy by way of appealunder Section 10 of the Act, 1905. However, in the interest ofjustice, impugned order is suspended for a period ofone (1) month.Petitioners shall take steps ro file appeal challenging the impugnedorders of respondent No.4 before respondent No.3 - RevenueDivisional Officer, Kothagudem Division, who-sh%ll pass orders on merits. Petitioners are also given tiberly to file InterlocutoryApplication seeking suspension of the order of eviction dated05.12.2023.
