HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDYWRIT PETITION No.40977 of 2014

Date:31.12.2014

Between:

Gali Narayanappa,S/o Venkatappa

..... Petitioner

And:

The State of A.P.,reptd by its Secretary,Civil Supplies Department,Hyderabad and three others.

.....Respondents

Counsel for the Petitioner: Ms Hema Latha Counsel for the Respondents: AGP for Civil Supplies (AP)

The Court made the following:ORDER:

This Writ Petition is filed for a Mandamus to setaside proceedings, vide Rc.No.625/2014E, dated15.07.2014, of respondent No.3.

On a perusal of the impugned order, this Court isprima facie satisfied that the charges on which thepetitioner’s fair price shop authorization has beensuspended are not serious enough warranting suchsuspension. Considering the fact that the petitioner hasapproached this Court more than five months afterpassing of the order of suspension and the enquiry ispending before respondent No.3, I decline to interfere withthe impugned order. However, respondent No.3 is directedto hold the enquiry by following the procedure explained in B.Manjula Vs. District Collector, Civil Supplies,Kurnool (Writ Petition No.32713 of 2011, dated26.11.2014) (a copy of the order is enclosed) and pass afinal order within one month from the date of receipt of acopy of this order.

Subject to the above direction, the Writ Petition isdisposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.51327 of 2014 filed by the petitioner for interimrelief is disposed of as infructuous.
