Petition under Article 226 of the constitution of India praying that in thecircumstances stated in the Affidavit filed herein the High Court will be pleased toIssue appropriate Writ, Order or direction more particularly one in the nature ofMandamus directing the respondents to consider and alienate the respectivequarters in which they are residing in favour of the petitioners as is down in othercases with respect to other Government Employees and pass.

The Court made the following :

ORDER:

Heard both sides and at their request the main Writ Petition itself is taken up fordisposal.

Petitioners herein and also the contesting respondents are all employees,who are aggrieved against the action of the respondents, in not alienating thequarters in their favour, which have been initially allotted in their favour during thecourse of employment.

Though several contentions have been raised from both sides, the factremains that some of the employees have already retired from service. The case ofthe petitioners is that in view of certain Policy decision taken by the Government,they are entitled to stay in quarters on permanent alienation basis rather thanevicting them soon after their retirement.

However, It is now agreed by both sides that the cases of those persons whoare in service can only be considered for alienation rather than those who havealready retired from service.

In view of the same, it is not necessary to go into the merits of the claim oneither side and it would suffice in the interest of justice to grant some time for evictionto those who have already retired and in regard to those who have not retired, their cases can be considered for the purpose of alienation.

Even though it is stated that now the Government has changed the policy,however, it has been pointed out on behalf of the employees that in spite of thesame, the allotment is being made to various other candidates and therefore, thereshould not be any impediment in considering their cases.

In the circumstances, the Writ Petition is accordingly, disposed of permittingthe employees who have already retired to vacate the premises on or before 30[th]June 2005. In regard to those who are in service, the authorities shall consider theircases for entitlement for permanent alienation, which exercise shall be done, withina period of three months, from the date of receipt of a copy of this order. It shall beopen for the parties to place all the material by way of representation or otherwise,before the concerned authorities for consideration of their cases.
