HON’BLE SRI JUSTICE NOOTY RAMAMOHANA RAOWRIT PETITION No. 33816 of 2010
O R D E R:
This Writ Petition has been instituted seeking directions to therespondent Andhra Pradesh State Road Transport Corporation toaccord necessary age relaxation to the petitioner and preference overdirect recruitees in appointment to the post of Shramik as notified on01.11.2010 on the same basis as it was done on an earlier occasion.
2. I have heard Sri G.V. Shivaji, learned counsel for the petitionerand Sri K. Satyanarayana Murthyu, learned Standing Counsel for theCorporation. Both the learned counsel have brought to my notice thatthis Court had occasion to consider the same question in Writ PetitionNo. 29626 of 2010 and batch and gave directions to the respondentCorporation to relax the upper age limit in favour of such of thosecandidates who have undergone apprenticeship with the respondentCorporation, in case they possess the necessary educationalqualifications and have undergone apprenticeship/training with the respondent Corporation, to an extent of four years for the posts ofShramiks, Mechanics and Artisans. It was made clear that theCorporation is entitled to select the candidates depending upon theirsuitability and the relaxation of the upper age limit is no way liable tobe construed as conferring any priority in the matter of selection of thecandidates.

3. In view of this judgment rendered by this Court on the previousoccasion, which was subsequently followed in many other cases, Iconsider that it is appropriate that the present writ petition should alsobe disposed of on the same lines, directing the respondentCorporation to accord relaxation of upper age limit to an extent of fouryears, provided the petitioner possesses the necessary academic ortechnical qualifications and that he has undergone theapprenticeship/training with the respondent Corporation and that hisapplication is otherwise in time and in accordance with the requisitesprescribed by the respondent Corporation. It is needless to observethat this relaxation of upper age limit to an extent of four years is only toenable the petitioner to compete along with all others and shall not betreated as a preference in the matter of selection.
4. The writ petition is accordingly disposed of at the admissionstage. No costs.
