ORDER:
The learned counsel appearing for the respondents fairlyconceded that the issue that arises for consideration in this writ petitionis squarely covered by order dated 16.07.2004 passed by this Court inW.P.Nos.8387 and 8412 of 2003, and therefore, this writ petition mayalso be disposed of in terms of the said order.
Hence, following the order dated 16.07.2004 passed by thisCourt in the above-mentioned writ petitions, this writ petition isdisposed of as under:
“Having regard to the fact that the petitioners havealready furnished the details of quantity of sale andconsignment being transported from their respectivepremises, including that of the particulars of thepurchasers, the respondents-Market Committee is atliberty to make an enquiry and can pass appropriate ordersincluding that of assessment of market fee and byspecifying the persons who are liable to pay the marketfee. Until the assessment is done in respect of the cottonseed, which were already sold to the licencees, withoutprior permission of the market committee, the petitionersshall not move the cotton seeds by way of consignment orotherwise outside the market area.”
While communicating this order, the Registry shall annex acopy of the order in W.P.Nos.8387 and 8412 of 2003 dated16.07.2004.
