THE HON'BLE DT, JUSTICE SHAMEEM AKTHERWRIT PETITION No.12576 of 2O21
The petitioner herein seeks a Writ of Mandamus declaring theaction of respondent Nos.2 and 3 in not taking any action in respect ofillegal construction being made by unofficial respondent No.4 inpremises bearing H.No.11-14-505, plot No.7, Sy.No.g/1/L, situated atSiri Nagar, Saroornagar, L.B.Nagar, Hyderabad, without permission andby occupying about two feet of land belonging to the petitioner asillegal, arbitrary and consequentry direct the respondent Nos.2 and 3 totake action in respect of the said iilegar construction by considering therepresentation, dated 27.04.202I, submitted by the petitioner.
2, Heard both sides, perused the record.
3. Learned counsel for the petitioner would contend that theunofficiar respondent No.4 started iilegar construction over the subjectpremises bearing H.No.11-14-505, plot No,7, Sy.No.9/1/1, situated atSiri Nagar, Saroornagar, L.B.Nagar, Hyderabad, without obtaining anypermission and by occupying about two feet of land belonging to thepetitioner. when the petitioner questioned the unofficiar respondentNo'4 regarding encroachment into his rand, the unorficiar respondentNo'4 threatened him with dire consequences. The petitioner submitteda representation, dated 27.04.202I, to the respondent No.3 requestingto take action against the said illegal construction, but however, noaction has been taken on the said representation till date. Takingadvantage of the same, the unofficial respondent is speeding up theconstruction activity and ultimately, prayed to allow the writ petition asprayed for.

5' Since the [resl,ondent ][Corporation ][haS ][initiated ][action ][pUrSuant to]the representation, dated [27.04.2021, submitted ][by ][the ][petitioner ][as]indicated above, nc further [directions ][are ][required ][to ][be given ][to ][the]respondent Corpora:ion.
