WRIT PETITION No:28577OF 2007

ORDER: (Per Hon’ble Smt. Justice T. Meena Kumari)

The present writ petition is filed by the petitioner seeking to declarethe action of the respondents in allowing to sell the liquor beyond 10.30 PMon 31.12.2007 and upto 1.00 PM on 1.1.2008 as arbitrary, illegal and inviolation of Articles 14 & 21 of the Constitution of India and to issueconsequential directions to the respondents not to allow to sell the liquor after10.30 PM on 31.12.2007.

The main grievance of the petitioner is that the Government haspermitted the sale of liquor in the State upto 1.00 A.M. in the night on the eveof New year day and such order of the Government would cause publicinconvenience besides causing much difficulty to the law and order situation.

Heard the learned Counsel appearing for the petitioner and thelearned Government Pleader and perused the material available on record.

In the facts and circumstances of the case and in view of New YearDay celebrations and in the interest of public, without expressing any opinionon the merits of the case, We feel it appropriate to dispose of the writ petitionwith a direction to the respondents not to allow the shops to remain opentoday after 12.00 mid night ie., on 31.12.2007.

Accordingly, the writ petition is disposed of. No order as to costs.
