THE HON’BLE SRI JUSTICE RAJA ELANGO
WRIT PETITION No.43616 OF 2016
ORDER:
The writ petition is filed seeking a writ of mandamus directing the respondents to issue LE-1 licence to the petitioner for manufacturing the fireworks and selling the crackers etc., at Survey No.20/7B of Kondakoppaka Village, Anakapalli Mandal, Visakhapatnam District, by declaring the action of the second respondent in not issuing the licence to the petitioner to manufacture fireworks in spite of compliance of all the formalities as arbitrary and illegal.
Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner is in the business of manufacturing and selling of fireworks, crackers etc. He further submits that the petitioner filed an application in Form No.AE-1 with all requisite documents before the second respondent and that the officials concerned submitted their reports with 'No Objection' for manufacturing of fireworks in the Survey No.20/7B of Kondakoppaka Village, Anakapalli Mandal, Visakhapatnam District, and opined that the petitioner's application can be considered. However, the second respondent is not issuing licence to the petitioner for manufacturing fireworks and crackers.
Considering the facts and circumstances of the case, the second respondent is directed to consider the application of the petitioner, dated 22.06.2013 and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of two months.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of.
