ORDER:

Learned Assistant Government Pleader for Civil Supplies hadtaken notice on 24.12.2007.

2. Heard both the counsel.

3. The writ petition is filed for a writ of mandamus declaring theproceedings vide RC B 2084/2007 dated 6.12.2007 issued by the firstrespondent as illegal, arbitrary and contrary to the provisions of A.P.State Public Distribution System Control Order and pass such othersuitable orders.

3. Several facts had been narrated in the affidavit filed in supportof the petition. It is stated that already an appeal had been preferredbefore the third respondent. It is needless to mention that the orderimpugned is only suspension pending enquiry. No doubt, the counselfor the petitioner had stated that the ground on which suspensionpending enquiry was ordered is totally an unsustainable ground. ThisCourt is not inclined to express any opinion on this aspect of the mattersince it is stated that an appeal had been preferred and the same ispending before the third respondent.

4. In view of the facts and circumstances, let the third respondentdispose of the appeal within a period of four weeks from the date ofreceipt of a copy of this order. Status-quo obtaining as on today shall be maintained till disposal of the appeal by the third respondent.

4. The writ petition is disposed of accordingly at the stage ofadmission. No costs.
