ORDER:

Heard the learned counsel for the petitioner.

It is stated that the petitioner applied for passport through an agentand the respondent has issued the same to the petitioner on22.8.2005, which is valid upto 9.4.2006 vide passport No.F4625976,but the date of birth is wrongly entered as 10.4.1987 instead of10.8.1988. It is stated that the actual date of birth of the petitioner is10.8.1988 as per the Secondary School Certificate issued by theBoard of Secondary Education, Andhra Pradesh.

The Secondary School Certificate of the petitioner goes to show thatthe petitioner studied 10[th] Class in Kakatiya High School,Hanumakonda, bearing Roll No.0634328 and the date of birth wasentered as 10.8.1988. To rectify the said mistake, the petitioner submits that he has filed a representation. But the respondent insteadof considering the said representation issued a letter dated 10.8.2005in Lr.No.C010630/05 advised the petitioner to get a declaratorydecree from the competent Civil Court for correction of date of birth.

Having regard to the facts and circumstances of the case, I am of theopinion that there cannot be any objection for the respondent tocorrect the date of the birth of the petitioner as 10.8.1988 basing onthe Secondary School Certificate issued by the Board of SecondaryEducation. Accordingly, the respondent is directed to correct the dateof birth of the petitioner as 10.8.1988 basing on Secondary SchoolCertificate either by issuing a fresh passport or by correcting thepassport already issued.

The writ petition is accordingly disposed of. No costs.
