THE HON’BLE SRI JUSTICE R.KANTHA RAOCRIMINAL PETITION No.15376 of 2013

ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C.seeking anticipatory bail for the petitioner/accused in Cr.No.478/2013on the file of Khammam I Town Police Station, Khammam District, registered for the offence punishable under section 420 of IPC.

Heard the learned counsel appearing for the petitioner/accusedand the learned Additional Public Prosecutor, representing the State.

The petitioner/accused is said to be the Agent of Prathibha GoldCompany. It is alleged that the petitioner/accused collected someamount from the de facto complainant who is a subscriber and did notrepay the amount even after maturity of the bond. It is further allegedthat the petitioner/accused in similar capacity collected huge amountsfrom several subscribers and failed to repay the amounts.

The learned counsel for the petitioner/accused submits that thepetitioner/accused is only a sub-agent and the Company has to repaythe amount to the de facto complainant.

I am not inclined to accept the contention urged by the learnedcounsel for the petitioner/accused. The petitioner/accused is notentitled for anticipatory bail in a case of this nature.

Accordingly the Criminal Petition is dismissed.
