AND

The State of A.P.,Rep. by the Public Prosecutor, High Court of A.P., Hyderabad & another .....Respondents HONOURABLE SRI JUSTICE P. SWAROOP REDDY

ORDER:

CRIMINAL PETITION No.11067 OF 2009

This Criminal Petition under Section 482 Cr.P.C. is filed by the petitioner Rachakonda Narender, accused, seeking to quash theproceedings against him in C.C. No.153 of 2008 on the file ofAdditional Junior Civil Judge, Jagitial, arising out of Crime No.257 of2000 of Jagtial Town Police Statio, Karimnagar District, registered forthe offences under Sections 420 & 506 IPC.

2. Heard.

3. Originally the C.C. is of 2001 – C.C. No.105 of 2001 and thesame was renumbered in 2008 as C.C. No.153 of 2008, which thepetitioner seeks to quash now in 2009. In the circumstances, obviously this petition is filed only to delay the disposal of the C.C.

Hence, without going into the merits of the case, the petition can bedismissed, as in case there is no prima facie case against thepetitioner, he ought to have approached this Court initially itself.

4. Therefore, the Criminal Petition is dismissed at theadmission stage itself. The petitioner is at liberty to take all the pleasbefore the trial Court.
