9. It is well settled that procedural laws are designed tofacilitate [justice, ]and not to frustrate the ends of justice. TheSupreme Courl in Kusum vs. Kanchan Devi and Ors', whileholding that the court has discretion to allow a written statement tobe filed beyond the stipulated period of 90 days, has observed asunder:
"6. All the rules of procedure are the handmaid of iustice. The lansuaseemnloed bv the draftsman ofDrocessual law mav be liberal or strinsentbut the fact remains that the obiect of prescribing procedure is to advancethe cause of iustice. In an adversarial svste m no party should ordinarilvbe denied the opoortunitv of DarticiDatin{r in the process of iusticedisoensation. Unless compelled by express and specihc language of theStatute, the provisions of the CPC or any other procedural enactmentought not to be construed in a manner which would leave the courthelpless to meet extraordinary situations in the ends ofjustice.
The mortality ofjustice at the hands of law troubles a Judge's conscienceand points an angry interrogation at the law reformer.and points an angry interrogation at the law reformer.
The processual law so dominates in certain systems as to overpowersubstantive rights and substantial justice. The humanist rule thatprocedure should be the handmaid, not the mistress, of legal justicecompels consideration of vesting a residuary power in judges to act exdebito justice where the tragic sequel otherwise would be whollyinequitable. - Justice is the goal ofjurisprudence - processual, as much as 'lzoosloscczos Sen v.
