ORDER:
This Contempt Case is filed by the petitioner aggrieved by theinaction of the respondents in implementing the order of this Courtdated 16.12.2011 passed in W.P.No.11829 of 2009.
2. As seen from the record, the petitioner filed the aforesaidWrit Petition for declaring the action of the respondents rejectingto rectify his date of birth in the Proceedings dated 11.05.2009, asillegal. While disposing of the Writ Petition on 16.12.2011, thisCourt on the representation made by the learned counsel for thepetitioner, gave a direction to the respondents to settle thepayment of salary of the petitioner within a period of one monthfrom the date of receipt of copy of the order and reportcompliance. As the respondents failed to comply with the saidorder, the present Contempt Case is filed.
3. During the course of enquiry, it is brought to the notice ofthis Court that as per the Proceedings dated 27.12.2012, a copy ofwhich is filed, the petitioner was paid the salary, for which he isentitled, vide Cheque bearing No.070276, dated 05.06.2012 on06.06.2012. The Provident Fund together with the employer’scontribution payable to the petitioner was also settled and paid on04.10.2012 through Cheque bearing No.238709, dated 24.09.2012. Thus, the entire salary was paid and the same was received bythe petitioner.
4. Therefore, as the order of this Court, dated 16.12.2011 in Writ Petition No.11829 of 2009 was complied with by therespondents, no purpose will be served by keeping the matterpending against the respondents under the guise of ContemptCase. Having regard to the facts and circumstances, absolutely Isee no grounds to maintain the Contempt Case in view of thecompliance of the order of this Court by the respondents in theaforesaid Writ Petition.
5. In the result, the Contempt Case is dismissed. However, the petitioner is at liberty to take appropriate steps / makerepresentation before the respondents for his grievance, if any, ifhe is otherwise entitled to as per Rules.
