Petitioners are the borrower ol respondent/Bank of India.For failure to r )pay the loan amount, respondent has initiatedproceedings agai rst the petitioners under the Securitization andReconstruction 'o [' ]Financial Assets and Enforcernent of SecuritvInterest Act, 2( C2 (briefly, the SARFAESI Acr hereinafter).Thereafter, the rr spondent/Bank of India has taken over physicalBabu, learned counsel for the petitioners.2. Since S.A."1o.244 [of ][2021 ][is ][pending ][belbre ][the ][Tribunal']we are of the vie [v ][that ][it ][would ][be ][just ][and ][proper ][if ][the ][petitioners]are reiegated [to ][.he ][forum ][of ][the Tribunal ][for ][adjudication ][of ][the]said securitizatior [application' ][From ][the ][materials ][on ][record' ][we ][find]that [the ][outstand ][ng ][dues ][of ][the petitioners is ][Rs'69'90'2'17 '33 as orr]31.012020' [I ][lowever' ][if ][the ][petitioners ][deposit ][15Yo ][of ][the]outstanding [d"es ][within ][a ][period ][of ][30 ][days ][trom ][today']

respondent/Bank of India shall not take further coercive stefs againstthe petitioners. The question regarding handing over possession backto the petitioners would be considered by the Tribunal. However, ifthere is any det-ault on the part of the petitioners, respondent/Bank ofIndia would be at liberty to proceed in accordance with law.
