TAKEN UP WRIT PETITION No.22138 OF 2006

ORAL ORDER:(per the Hon’ble Mr. Justice D.S.R.Varma)

Heard the learned Government Pleader for Home, representing the learned Advocate General, appearing forthe respondents.

2. This writ petition is taken up on the basis of atelegram, dated 23.10.2006, by the petitioner – NadamalaChinna Venkatareddy, to the Hon’ble the Chief Justice,High Court of Andhra Pradesh, Hyderabad, alleging thathis son by name Nadamala Nageswara Reddy, wasmissing since 03.07.2006 and that though a complaintwas made to the police, which was registered as CrimeNo.94 of 2006, under the Head ‘Man Missing’ on19.07.2006, no action is being taken by the police.

3. In response to the notice, issued by this Court, theInspector of Police, Yerraguntla Police Station, KadapaDistrict, filed counter-affidavit stating, inter alia, that themissing person was called to the Police Station on30.06.2006 in connection with Crime No.85 of 2006,registered for the offences punishable under Sections 3and 5 of the Explosive Substances Act and that thestatement of the father of the missing boy i.e., thepetitioner, was also recorded on 19.07.2006, who statedthat his son went to the Police Station on 03.07.2006 tomeet the Sub-Inspector of Police in connection with anenquiry in Crime No.85 of 2006, returned to his house, had coffee and left for Chilamakur village and since thenhe was not to be seen.

4. From the above, it appears that there is change in the version of the petitioner about the actual date ofmissing of his son. However, the investigation is still goingon.

5. Therefore, we feel it expedient to close the writpetition with a direction to the Superintendent of Police,Kadapa District, to intensify and monitor the investigationand to report the progress, if any, to the Registrar(Judicial), High Court of Andhra Pradesh, Hyderabad.

6. Subject to the above direction, the writ petition isclosed, at the stage of admission. However, there shall beno order as to costs.
