We do not find any merit in the allegations made in the FaxMessage dated 7.12.2007 sent by the petitioner about the illegaldetention of her husband viz., Subba Raju by the police since6.12.2007, in the light of the averments made in the counter, wherein itis categorically stated that the husband of the petitioner is an accusedNo.1 in connection with Crime No.184 of 2007 registered for theoffences under Sections 143, 323, 341, 506 r/w 34 IPC of YerraguntlaPolice Station. During the course of investigation, the alleged detenuwas taken into custody on 10.12.2007 along with other accused and produced before the III Additional Judicial First Class Magistrate,Kadapa. On such production, the learned Magistrate was pleased toremand him to judicial custody and later, he was enlarged on regularbail on 10.12.2007.
The writ petition is accordingly dismissed. No costs.
