DATED: 26..12..2005

BETWEEN:

And

The Union of India, Ministry of Finance Department of Economic Affairs, Central Secretariat, New Delhi, Rep. by its Secretary to Government of India and Five others … Respondents THE HON’BLE SRI JUSTICE C.Y.SOMAYAJULU

WRIT PETITION NO. 27560 of 1996

ORDER:

This writ petition is filed questioning the notification dated 30-11-1994 issued under Section 3 of the Recovery of Debts of Banks and FinancialInstitutions Act, 1993, (the Act) and the order of the Civil Court transferring the casefiled against the petitioner by the first respondent-bank to the Debt RecoveryTribunal.

In view of the ratio in “UNION OF INDIA AND ANOTHER v. DELHI HIGH COURTBAR ASSOCIATION” upholding the validity of the Act, I find no merits in thispetition. Hence the petition is dismissed with costs.
