The present writ petition has been filed as a publicinterest litigation by the petitioner, who is a retiredAssistant Sub Inspector of Poiice, stating that therespondent No.2 is establishing a t32/33 KV and 1i/32KV electric substation within 1.5 km from a runningpetrol bunk on its western side and 2.00 metres awayfrom a Government Matemity Hospital falling on itseastern side. It has been stated that the respondentsAssistant Sub Inspector of Poiice, stating that therespondent No.2 is establishing a t32/33 KV and 1i/32KV electric substation within 1.5 km from a runningpetrol bunk on its western side and 2.00 metres awayfrom a Government Matemity Hospital falling on itseastern side. It has been stated that the respondentsState is violating the Central Electricity Authority (SafetyRequirements for Construction, Operation andMaintenance of Electrical Plalts ar-rd Electric Lines)Regulations, 201 1, as well as the Notification datedMaintenance of Electrical Plalts ar-rd Electric Lines)Regulations, 201 1, as well as the Notification dated12.02.2016 issued l.ly the petroleum and Natural GasRegulatory Board and therelbre, the follou,ing prayer hasbeen made in the pr.tblic interest litigation:- ._ [?]

"lt is thereforc humbl.v prayed that this Hon'b1eCourt may be pleased to issue a writ or writs moreparticularly a writ of mandamus declaring that theaction of the respondent No.2 in setting up a 132/33KV and lll32 KY, electric sub station, within 1.5metres from a running petrol bunk/station and 2metres from a government matemity hospital, at petlaBurj, City College Road, Hyderabad, is illegal andagainst the Electricity Act and Rules.

It is also humbly prayed that this Hon,ble Courtmay be pleased to direct the respondents No.2 to stopthe work of setting up a 132/33 KV and 11/32 KV,electric sub station, within 1.5 metres from a runningpetrol bunk/station and 2 meters from a governmentmaternitv hospital, at Petla Burj, Cit], College Road,Hyderabad, pcnding clisposal oI prcsent W.p.(pll), inthe intercst ol jrrstice ancl cqulty."

A counter affidavit has been filed in the matter bythe Trarsmission Corporation of Telangana Limite d(TSTRANSCO) and it has be en stated that theTSTRANSCO technical team has inspected the allotedland and taking into consideration the sma11 extent arrdthe presence of petrol station adjacent to the land, hasproposed the Gas Insulated Substation (GIS) and erectionof fire protection walls with a height of 9 metres i.e., 30feet abutting the petrol station for protecting artdisolating the same. It has further been stated that thereshall be no openings in the building to be constructedtowards the petrol station and the height of the building, shall be more than 11 metres with specially reinforced ili c walls to avoid any fire or any accidents. Learned counselfor the petitioner, at this stage, has stated before thisCourt that a tender has been issued. However, suchspeci{ications do not lind place in the tender.

Arguments

Learned counsel appearing for the TSTRANSCO isfair enough in stating before this Court that they shatl beissuing a tender keeping in view the statement made inissuing a tender keeping in view the statement made inthe counter affidavit in paragraphs 7 and 11. paragraphs7 and 71 of the counter affidavit Iiied by the TSTRANSCOare reproduced as under:-7 and 71 of the counter affidavit Iiied by the TSTRANSCOare reproduced as under:- "7. It is submitted that the TS TRANSCo TechnicalTeam has inspected the allotted land and after takinginto consideration the small extent and the presence ofthe Petrol Station adjacent to the land has proposedthe Gas Insulated Sub Station (GIS) and erection ofFire Protection walls with a height of 9 meters ie., 30feet abutting the petrol Station for protecting andisolating the same. 'l'here shall be no openings in thebuilding to be constructed towards the petrol Stationand the height of the building shail be more than 11meters with specially reinlorced u,alls to avoid any fireor any accidents.

It is submitred that the letter dated: 11_07_2018oI the manufacturer oI Nitrogen lnjection Type FirePrevention cum Extinguish System (NlFpS) disclosesthat the said systems are instailecl in the refineries ofHindustan Petroleum Corporation Limited, BharatPetroleum Corporation Limited, Indian Oil CorporationLimited, Oil and Gas Corporation Limited and GasiAuthority of Inclia and also in Nuclear plants. In the light of the aforesaid, the present publicinterest litigation is disposed of with a direction to therespondents to issue a tender strictly in consonance witlrthe statement made on an aflidavit before this Court andthe respondents are permitted to establish 132/33 KVarLd ll 132 I(V electric substation, subject to fulfilment ofthe conditions mentioned above.

In view of the above, the conternpt case is alsoclosed.

The miscellaneous applications pending, if any,shall a-1so stald closed. There sha.l1 be no order as to costs.
