THE HON’BLE SRI JUSTICE V.V.S. RAOWRIT PETITION No.25144 of 2006

The petitioner is allegedly the owner of land admeasuringAcs.10.31 guntas in survey Nos.30 and 38 situated at RukmapurVillage of Choppadandi Mandal in Karimnagar District. She statedlypurchased the same from M/s.Y.Goura Raju and Y.Satyanand Gandhiunder registered sale deeds in 1981. The second respondent hereininitiated action under the provisions of the Andhra Pradesh AssignedLands (Prohibition of Transfers) Act, 1977 (“the Act”, for brevity).Alleging that the vendors of the petitioner purchased the land incontravention to the provisions of the Act, an order was passed by theMandal Revenue Officer on 31.03.1998 for resumption of the land inpossession of the petitioner. The petitioner filed a writ petitionunsuccessfully. In W.A.No.899 of 1999, dated 10.08.1999, this Courtsent back the matter to the first respondent ordering Statusquo. Pursuant to the said order, the first respondent heard the appeal andallowed on 31.03.2000. Again the second respondent initiated actionand passed orders on 16.04.2005, ordering resumption. The petitioneragain filed W.P.No.10697 of 2005. The same was disposed of by thisCourt on 29.04.2005 giving liberty to the petitioner to avail the remedyof appeal under Section 4-A of the Act. He accordingly filed appealbefore the first respondent in June, 2005. He also moved anapplication for stay, but no orders were passed. As the appeal is stillpending, he filed the present Writ Petition seeking a direction to theappellate authority to dispose of the appeal.

When the matter was initially listed before this Court on04.12.2006, the learned Assistant Government Pleader for Revenue(Assignment) requested time for getting instructions. Again when thematter came on 18.12.2006, the learned Assistant GovernmentPleader brought to the notice of this Court that the matter was comingup for hearing before the Revenue Divisional Officer on that day, andtherefore, it was adjourned. Today when the matter is called, thelearned Assistant Government Pleader submits that the RevenueDivisional Officer was transferred on 16.12.2006 and that the newRevenue Divisional Officer has taken charge. He submits that there islikelihood of disposal of the appeal within a period of ten days.

In view of the submissions made by the learned AssistantGovernment Pleader, while ordering Statusquo as on today, the firstrespondent is directed to dispose of the appeal filed by the petitioneragainst the orders, dated 16.04.2005 of the Mandal Revenue Officer,Choppadandi, within a period of ten days from the date of receipt of acopy of this order.
