JUDGMENT:
Today, when the matter is taken up for hearing, the learnedcounsel for the appellants seeks permission of this Court towithdraw the Appeal.
On the other hand, the learned counsel for the respondentssubmits that since the suit in O.S.No.183 of 1985 was dismissedbefore the trial Court, aggrieved by which, the present appeal hasbeen preferred and since the suit is of the year 1985 and the sameis pending all these years, he has no objection for dismissing theappeal as withdrawn awarding costs.
I do not see any merit in the submission of the learnedcounsel for the respondents.
Permission is accorded for the appellant for withdrawingthe appeal.
Accordingly, the Appeal is dismissed as withdrawn. No costs.
