:O R D E R:

The petitioners are residents of Rock Town Colony, Behind L.B. Nagar Traffic PoliceStation, L.B. Nagar, Hyderabad. They applied to respondent viz., HyderabadMetropolitan Water Supply and Sewerage Board, Hyderabad (‘the Board’ for brevity)for 15 M.M. Æ water connection for the residents. The same was allegedlysanctioned on 12-05-2005, but respondent did not provide water connection. Hencethey filed the writ petition inter alia seeking a direction to the respondent to providewater connection to the petitioners’ premises.

On 05-12-2005, learned standing counsel for the Board sought time for gettinginstructions in the matter. She also filed a counter affidavit on behalf of therespondent. It is stated that as per the procedure, the colony or the residents of thecolony are required to bear 30% of the expenditure for laying down pipeline. Theestimated expenditure is Rs.75,00,000-00 and the Rock Town Colony is required topay a sum of Rs.22,50,000-00, but they paid only Rs.18,00,000-00 towards theircontribution as a result of which the work could not be taken up. It is also stated thatthough the Colony, where the petitioners have houses, is included within thejurisdiction of the respondent by reason of orders of the Government in G.O.Ms.No.186 M.A. & U.D. (Elec.II) Dated 20-04-1999, the work could not be completed forwant of balance by the association of the Colony. She also submits that the L.B.Nagar Municipality, where the Colony is situated, was not sanctioned 70% of thecontribution.

The petitioner has not filed any reply affidavit denying the counter averments.Learned counsel for the petitioners has not placed before this court any material insupport of the contention that water supply can be given to the petitioners’ houses inRock Town Colony from a transmission line, which is passing through another Colony without the consent of the other Colony. Therefore, the petitioners have toawait till such time the petitioners’ Colony fulfills the requirement of paying the entire30% amount towards the estimated cost of laying pipeline in Rock Town Colony.

In this writ petition, no relief can be granted. The writ petition is, accordingly, dismissed. No costs.
