ORDER:
The 1stpetitioner is the owner of Auto bearing Reg.No.AP 36W 1225.The vehicle in question is involved in Crime No.234 of-20102011 of Prohibition and Excise station, Kazipet, WarangalDistrict, registered for the offence punishable under Section 34(a) & (e) of the A.P. Excise Act.
In view of the said involvement, the auto in question wasseized and as such, the present petition is filed seeking for release ofthe same.
Heard the learned Counsel for the petitioners.
Having regard to the submissions made by the learned Counselfor the petitioners and in view of the fact that the 1stpetitioner is theowner and is eking out his livelihood from out of the income derivedfrom the vehicle in question, this Court is of the view that the vehicle inquestion can be ordered to be released in favour of the 1stpetitionerby imposing certain conditions.
Accordingly, the vehicle in question is hereby ordered to bereleased in favour of the 1stpetitioner on the following conditions:
1) The 1stpetitioner shall execute a bond for a sum of--Rs.50,000/ (Rupees Fifty Thousand only) with twosureties for the like sum each to the satisfaction of theS.H.O., Prohibition & Excise Station, Kazipet, WarangalDistrict.sureties for the like sum each to the satisfaction of theS.H.O., Prohibition & Excise Station, Kazipet, WarangalDistrict.
2) He shall give an undertaking that he will produce the vehiclein question as and when required and he shall not alienatein question as and when required and he shall not alienate the same during the course of enquiry, investigation andtrial.
Subject to the above conditions, the Criminal Petition isallowed.
