.....RESPONDENT

Petition under Article 226 of the constitution of India praying that in thecircumstances stated in the Affidavit filed herein the High Court will be pleased toissue a writ of Mandamus or any other appropriate writ or order or direction quashingthe notice dated 19.8.2004 issued by the respondent under Section 13 (4) of theSecuritisation and Reconstruction of Financial Assets and Enforcement of SecurityInterest Act 2002, illegal and void, and to pass such other order or orders.

Counsel for the Petitioners: MR.S.V.S.CHOWDARY

Counsel for the Respondent No.1: MR.DEEPAK BHATTACHARJEE

The Court made the following Oral Order: (per Sri Devinder Gupta, CJ)

The grievance of the petitioners is against the action of the respondents in issuingnotice under Section 13(2) of Securitisation and Reconstruction of Financial Assetsand Enforcement of Security Interest Act, 2002 (for short ‘the Act’), against thepetitioners qua the mortgaged property, which also includes agricultural land.

Section 31(i) of the Act says that provisions of this Act shall not apply to any securityinterest created in agricultural land.

In this view of the matter, we allow the writ petition and set aside the notice issued tothe petitioners under Section 13(2) of the Act qua the property, which has beendescribed therein as agricultural land. For the remaining property, in case, petitioners have any grievance, they are at liberty to seek appropriate remedy inaccordance with law.

The writ petition is accordingly allowed. No costs.
