WRIT PETITION NO. 25972 OF 2006

Between:

Cheekati Punyavathi

Petitioner

AND

The Station House Officer,Gara Police Station,Gara, Srikakulam District and others Respondents ORAL ORDER:(Per the Hon’ble Sri Justice P.Swaroop Reddy)

This is a taken up writ petition on the basis of apetition dated 1.12.2006 sent by the petitioner addressedto the Hon’ble the Chief Justice, stating that her son byname Cheekati Ramesh was taken to Magathalapudu,Gara Mandal, Srikakulam District, as driver, but he did notreturn. It is further stated by her that she was informed thather son was drowned in the sea and a case in Cr. No. 86of 2005 was registered by the Gara Police. She furtheralleges that the police are not informing her as to whetherher son is dead or alive. She, therefore, prays that if herson is alive, he may be produced.

In response to the notices issued by this court, theAssistant Sub-Inspector of Police, Gara Police Station, filed counter affidavit stating that son of the petitioner wentfor picnic to sea-shore and while taking bath in the sea, hewas washed away by the tidal waves and his body wasnot recovered, as such, they are unable to confirm hisdeath. It is further stated that the since there were noclues, the police have referred the matter as undetectable.

Thus, this is a case where the boy was washedaway into the see by the tidal waves and his dead body isnot traced and since the dead body is not found, thepolice are unable to confirm his death.

In view of these revelations, there is nothing that canbe done except directing the police to inform the petitionerabout result of the investigation.

With this direction, the writ petition is disposed of. Noorder as to costs.
