ORDER:
THE HON’BLE SRI JUSTICE C.V.RAMULU W.P.No.20584 of 2007
Heard both sides.
It appears that pursuant to the interim orderdated 1.10.2007 passed by this Court in WPMPNo.26629 of 2007, the petitioner has beenreinstated into service and is working as aConductor.
Coming to the merits of the case, the sum and substance of the charges leveled against thepetitioner is defrauding of the revenues of therespondent-Corporation by not accounting the saleof tickets of Rs.8/- and Rs.9/- denominationsproperly in the star document No.43/738506maintained by him on 1.8.2007 and 2.8.2007. Thiscame to light only when a random scrutiny was conducted by the Depot authorities. This is purely amatter of record and no further evidence isrequired. Further, there is no grave public interestinvolved requiring suspension of the petitioner, pending enquiry. As such, the impugned order isliable to be set aside.
Accordingly, the writ petition is allowed and the impugned order is set aside. However, this will notpreclude the respondents from conducting adetailed enquiry into the matter and passingappropriate orders, as per law. No costs.
