ORDER:

This Writ Petition is filed for the following substantive relief.

“…to declare the action of the respondents in not handingover the possession of the house sites admeasuring 60 squareyards each, covered by survey No.579, New ShayampetVillage, Hanamkonda Mandal, Warangal District, though thepatta was granted in favour of the petitioners on 24.04.1998, asillegal, arbitrary and consequently to direct the respondents todeliver possession in respect of house sites admeasuring 60square yards each in survey No.579 situated at New ShayampetVillage, Hanamkonda Mandal, Warangal District, to thepetitioners.”

It is indeed incredulous that the petitioners, in whose favour thehouse site pattas were granted as far back as 24.04.1998, have not beenhanded over physical possession of the house sites.

Learned Assistant Government Pleader for Revenue(Assignments), on instructions confirming the claim of the petitioners thatthey were not granted house site pattas, submitted that respondent No.2will very shortly hand over physical possession of the same to thepetitioners.

In view of the above submissions of the learned AssistantGovernment Pleader for Revenue (Assignments), respondent No.2 isdirected to hand over physical possession of the house sites to thepetitioners within one (1) week from the date of receipt of this order.

Subject to the above direction, the Writ Petition stands disposed of.

As a sequel to disposal of the Writ Petition, WP.MP.No.48052 of2013 filed by the petitioners for interim relief shall stand disposed of asinfructuous.
