WRIT PETITION NO.38360 OF 2014

ORDER:(per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)

This writ petition for issuance of habeas corpus is taken up forhearing. It is alleged in the writ petition that the alleged detenu wasillegally detained by the Police, whereas in the counter affidavit it hasbeen specifically stated that the alleged detenu is wanted inconnection with a criminal case pending against him, and he wasabsconding for some time and the allegation of factual detention isabsolutely incorrect. He could not be traced earlier but now he istraceable and the Police will arrest him in connection with the criminalcase.

We therefore close the writ petition directing the InvestigatingOfficer or the Police Officer concerned to arrest the alleged detenuforthwith and immediately thereafter produce him before the concernedlearned Magistrate. There will be no order as to costs.
