ORDER:

WRIT PETITION NO.27878 OF 2005

The petitioner is a resident of Gachibouli, Serilingampally Mandal, Ranga ReddyDistrict. He was allegedly assigned house site by way of D-Form patta admeasuring180 Sq.yards in Plot No.97, in S.No.136 situated at Gachibouli, where he raised ahut and staying there. It appears, while taking up road widening programme, some ofthe persons belonging to weaker sections were dislocated and the Government iscontemplating to allot house sites to those persons. Apprehending that he might beevicted with force de hors due process of law, the petitioner invoked jurisdiction ofthis Court under Article 226 of the Constitution of India seeking appropriate relief.

As rightly pointed out by the learned Assistant Government Pleader for Revenue (Assignment), the Writ Petition is filed on mere apprehension. However, therecannot be any doubt that unless and until the petitioner is given notice of eviction, the respondent authorities cannot take any coercive action against petitioner.

The Writ Petition with the above observations is accordingly dismissed.
